If it is discovered that TheArtOfExposure.com does not have the exclusive rights of any Accepted Image, TheArtOfExposure.com will withdraw that Accepted Image from the site. The Photographer agrees to indemnify TheArtOfExposure.com for all costs associated with the withdrawal of the Accepted Image including administration costs, material costs, and promotional costs incurred in the duping and distributing the Accepted Image. Neither party shall be liable to the other party for indirect, incidental, consequential (including lost profits or business opportunities), special, exemplary or punitive damages.
Nothing in this Agreement will constitute the relationship of an employer and employee, agency, partnership or a joint venture between TheArtOfExposure.com and the Photographer. Both parties agree that the Photographer is a member. All notices to be served in accordance with this Agreement may be served by e-mail or by mail. Photographer agrees to notify TheArtOfExposure.com promptly of any change of contact information (address, e-mail, etc.) for the purpose of notification pursuant of this Agreement. To the extent that any provision is deemed illegal, void, or unenforceable, that provision shall not affect the remaining provision of the Agreement, which shall remain in full force and effect.
We reserve the right to make changes to our site, alter the terms, conditions, and privacy policies, and this "Terms and Policies of Use" agreement at any time and in our sole discretion.
